About these terms
These terms apply to all services provided by Kiilu (operated by Malin and Jimmy, Algarve, Portugal) including UGC content creation and web development. By engaging our services, you agree to these terms.

Our services
Kiilu offers UGC content creation (video and photo assets for use in paid advertising and organic social media) and web development (design and build of websites and landing pages). The specific deliverables, timelines and pricing for each project are agreed upon before work begins and confirmed in writing.
Quotes and pricing
All prices shown on this website are starting points and subject to project scope. A final quote is provided after an initial consultation. Prices are in euros (€) and exclusive of VAT. Private individuals will be charged VAT. EU businesses with a valid VAT number are invoiced without VAT (reverse charge). Non-EU customers are invoiced without VAT.
Quoted prices are valid for 30 days from the date of issue.
Payment
Projects are invoiced in three stages: a 50% deposit before work begins, 25% upon approval of the design, and 25% upon delivery of the completed site. Monthly care plans are billed at the start of each month.
Late payments may result in work being paused or delivery being withheld. Outstanding balances unpaid after 14 days of the due date may incur a late payment fee. We reserve the right to suspend ongoing services until all outstanding invoices are settled.
Revisions
Each package includes a set number of revision rounds as specified in your quote. Revisions are changes within the agreed scope — not new directions or additional features. Work beyond the included rounds is quoted separately.
Delivery and acceptance
Work is considered delivered when the completed project is shared with the client for review. If no written feedback is received within 7 days of delivery, the project is considered accepted as delivered. Any corrections identified after this period may be addressed at our discretion or quoted separately.
Post-delivery support
For web projects, Kiilu will address bugs or technical errors directly caused by our own work at no additional charge for 14 days following acceptance. This does not cover changes in scope, failures of third-party services, or issues arising from client modifications made after handover.
Intellectual property
Upon receipt of full payment, the client receives full usage rights to all final delivered assets. Until full payment is received, all work remains the intellectual property of Kiilu and may not be published or used. Kiilu retains the right to display the work in its portfolio unless the client requests otherwise in writing before the project begins.
Any third-party assets (stock footage, fonts, plugins) used in a project remain subject to their own respective licences.
Client responsibilities
The client is responsible for providing accurate content, brand assets and feedback within agreed timeframes. Delays caused by late feedback or missing assets may affect delivery timelines and are not the responsibility of Kiilu.
The client warrants that any materials provided to Kiilu (logos, images, text) do not infringe on third-party rights.
Cancellations
If a client cancels a project after work has begun, the deposit is non-refundable. Any work completed up to the point of cancellation will be invoiced at the agreed hourly rate if it exceeds the deposit value.
Termination by Kiilu
Kiilu reserves the right to terminate a project if: the client fails to make payment within 14 days of a due date; the client fails to provide required materials or feedback within a reasonable timeframe, causing the project to stall; or the client's conduct becomes unreasonable. In such cases, all work completed to date will be invoiced and the deposit remains non-refundable.
Force majeure
Kiilu is not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to illness, internet or infrastructure outages, natural events, or third-party service failures.
Third-party services
Projects may rely on third-party platforms such as Vercel (hosting), Sanity (CMS), Supabase (database), Shopify, Web3Forms (contact forms), or analytics tools. Kiilu is not responsible for changes, downtime, pricing adjustments, or discontinuation of any third-party service. After handover, the client is responsible for maintaining their own accounts and subscriptions with such services.
Limitation of liability
Kiilu's total liability for any claim arising from services provided is limited to the amount paid for the specific project in question. We are not liable for indirect, incidental or consequential losses.
Governing law
These terms are governed by the laws of Portugal. Any disputes will be subject to the exclusive jurisdiction of the Portuguese courts.
Changes to these terms
We may update these terms from time to time. The current version always applies to new projects. Ongoing projects remain subject to the terms agreed at the time of engagement.
